Short answer: usually you can sign a contract once someone has legal authority to act for the estate. Closing happens when the estate can convey clean title. Here's how that plays out in New Jersey.
If there's a will, the executor named in it applies to the county surrogate's office and receives letters testamentary. If there's no will, a close relative applies to be administrator and receives letters of administration. In most NJ counties this is a straightforward appointment, not a court hearing. Once those letters exist, the executor or administrator can sign a contract to sell the house.
Before closing, the title company will need the letters, the death certificate, and New Jersey's inheritance tax clearance or waiver for the property. Whether a waiver is automatic or requires a filing depends on who inherits; spouses and children are treated differently from siblings, nieces or friends. Your estate attorney or the title company handles this. We've closed enough estate sales to know what to ask for early so it doesn't stall the closing.
If the house was held jointly with a surviving spouse or in a living trust, probate may not be needed at all for the sale. Tell us how the deed reads and we'll tell you what the title company will likely want.
